Welcome to talbench.com (the “Platform”), owned and operated by Atomsharp L.L.C (“TalBench,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your use of the Platform, including the ability to post and view candidate profiles, job opportunities, and communicate with other users.

1. Acceptance of Terms

By creating an account or using our platform, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the platform.

2. User Eligibility

You must be at least 18 years old and authorized to represent a company or organization to use this platform.

3. Account Information

During account creation, we collect the following details:

• Full Name
• Email Address
• Phone Number
• Company Name
• Website

You agree to provide accurate and up-to-date information and to keep your login credentials secure.

4. Use of Platform

TalBench allows users to:

• Post bench candidate profiles (without PII).
• Post job opportunities.
• Send messages to other users regarding specific posts.

Both vendors and clients share the same interface and can perform these actions equally.

5. Content Responsibility

You are solely responsible for the content you submit, including bench candidate details or job descriptions. While we do not collect or request personally identifiable information (PII) of candidates, we provide open text boxes where such data could be entered. You must not enter any PII such as full names, email addresses, phone numbers, or government IDs.

TalBench is not liable for any misuse, privacy violations, or legal consequences arising from user-submitted content. We reserve the right to remove content that violates these Terms or any applicable law.

6. Messaging and Email Disclosure

When you send a message regarding a job post or candidate profile, TalBench will notify the recipient via email. This email will include your:

• Full Name
• Email Address
• Company Name

By using the messaging feature, you consent to this disclosure.

7. Prohibited Conduct

As a user, you agree not to:

• Submit any PII of candidates.
• Upload false, misleading, or unlawful content.
• Impersonate another user or organization.
• Spam, harass, or solicit other users unrelated to platform activity.
• Reverse engineer or tamper with the platform’s code or services.

8. Ownership and License

You retain ownership of the content you submit. However, by submitting content, you grant TalBench a non-exclusive, royalty-free license to store, display, and use it solely to operate and promote the platform.

9. Termination of Use

We reserve the right to suspend or terminate your account at any time for violations of these Terms, abuse of the platform, or at our sole discretion.

10. Limitation of Liability

TalBench is provided "as is" and we make no warranties of any kind. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform or content submitted by users.

11. Data Privacy

We take user privacy seriously. We do not store or request PII about candidates. However, users may voluntarily submit information through free-text fields. We are not responsible for such user-submitted PII. For full details, see our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted here and are effective immediately. Continued use of the platform after changes means you accept the updated Terms.
